Privacy Policy

Introduction

WHAWHEE is a network conceptualized to exchange information about your passions. The goal is that other people can gain from your experiences to pursue their passions to the fullest. So we invite you to publish only information that you wish to share. WHAWHEE is not conceptualized to expose your private life or information you do not want to share with a selected group.

This Privacy Policy describes WHAWHEE policies and procedures on the collection, transmission, manipulation, storage, disclosure and processing of your information when you use WHAWHEE services through the WHAWHEE website, through a mobile phone, or through any WHAWHEE´s applications for mobile devices. Being part of WHAWHEE means sharing information about you with other people and communicating with them. By default, your account is configured to share the information, we have found the vast majority of our users are interested in sharing. But the amount and type of information, you decide to share, and with who to share, is up to you.

We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means or from other sources.

1. Collection of Information. WHAWHEE uses the information we collect to analyze how you use our services, diagnose technical problems of services, maintain security, personalize content, remember information to help you access your account efficiently, monitor aggregate metrics of services, traffic patterns and demographics. In this sense, we collect your personal information in the following ways:

a) At the time of registration. In order to become a WHAWHEE user, you must provide at least the following information to create an account: name, email address, location, date of birth and password. Without this minimal amount of information, you cannot create a WHAWHEE account. WHAWHEE may request other information from you during the registration process (e.g., activities you practice and where you practice them, etc.) used to provide better and more personalized services, such as profile pages in specific languages and better ads. You acknowledge that this information is personal, and by creating an account on WHAWHEE, you allow others, including WHAWHEE, to identify you and use your information in accordance to our Terms of Use.

b) Information from your profile. Once you become a user, you can provide additional information to your WHAWHEE profile. Providing additional information about yourself beyond what is minimally required at registration is entirely up to you, but providing additional information enables you to derive more benefits from WHAWHEE. Any information you provide at registration or in your Profile section may be used by WHAWHEE as described in our Terms of Use and this Privacy Policy. We may also collect information from the content you provide on the Services, for example, from images, we may collect information describing your camera and camera settings. This information allows us to improve services and offer additional features and functionality.

c) Content posted by Users. By default, all content that you post or share through WHAWHEE Services are public, which means that the content published and shared is accessible to everyone, including search engines. Therefore, you should assume that anything you post or share through WHAWHEE Services is publicly accessible, and you may lose any privacy rights you may have about that content. In addition, information shared may be copied and shared across the Internet. Although you are free to remove any content you have posted or shared from your account, due to the nature of Internet sharing, there is a strong possibility that there may be copies of your content elsewhere and that could stay indefinitely, even in our systems.

d) Customer Service. WHAWHEE collects information when you interact with our customer service website to accurately categorize and respond to customer inquiries and investigate violations of our terms of use.

e) When you use WHAWHEE’s services and applications. WHAWHEE receives and collects information when you interact with and use the WHAWHEE website and WHAWHEE applications (e.g., for mobile devices, etc.) and about how you use the Services. This includes general purpose information, and may include information such as the number and frequency of visits, the pages or characteristics of the services you have visited, and duration of such visits. This information allows us to find out how often people use the services so we can analyze and improve them. Some of this information may be associated with the IP address (as defined below) used to access the Services, and some may be associated with your account, such as searches topics and pages you visit. We can also use some of this data in a disaggregated way, i.e., as a statistical measure on all our users that does not identify you personally. We use information about your use of the Services to enhance your experience on the Services.

f) Cookies. Like most websites, we use cookies and other web log files to track site usage and trends, to improve the quality of our service, to personalize your experience on WHAWHEE and to provide third-party advertising to users, both inside and outside the WHAWHEE site. When using the service, we use session and persistent cookies and other tracking technologies to: (i) Store your user name and password, (ii) Analyze the use of the services, (iii) Customize the service to your preferences; and (iv) Control advertising for services rendered. A persistent cookie remains on your computer after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your Internet browser instructions. A session cookie is temporary and disappears after you close your browser. You can set your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the services may not function properly if the ability to accept cookies is disabled. We may also use other Internet technologies and other methods to gather additional information. In order to optimize services to our users, we may allow authorized third parties placing or recognizing a unique cookie on your browser. Any information provided to third parties through cookies will not be personally identifiable but may provide general segment information (e.g., on their geographic location, preferences, etc.) to improve the user experience by providing more relevant advertising.

g) Log files, IP addresses and information about your computer and/or mobile device. Due to the communications standards on the Internet, when you visit the WHAWHEE website we automatically get the URL of the site from which you came and the site to which you go when you leave. WHAWHEE also receive the Internet protocol ("IP") address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and the type of web browser you are using, email patterns, the mobile device (including your UDID) and mobile operating system (if you are accessing WHAWHEE using a mobile device), and the name of your ISP or your mobile carrier. WHAWHEE may also receive location data passed to it by other services or devices that have GPS enabled. The link between your IP address and your personally identifiable information is not shared with third parties without your permission, except in compliance with a legal requirement, as specified in subsection f) of section 2 of this policy.

2. Uses of the collected information. As previously indicated, WHAWHEE uses the information we collect to analyze how you use our services, diagnose technical problems of the services, maintain security, personalize content, remember information to help you access your account efficiently, monitor aggregate metrics services, traffic patterns and demographics. In that sense, we use your personal information in the following ways:

a) Consent to process your information. The information you provide to WHAWHEE may disclose or allow others to identify your nationality, ethnicity, gender, age and other aspects of your lives. By providing information to us for the purpose of creating your user account or adding any additional details to your WHAWHEE profile, you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and WHAWHEE’s Terms of Use. Providing information to WHAWHEE, including any information deemed "sensitive" by applicable law, is entirely voluntary on your part. You have the right to withdraw your consent to the collection and processing of your information at any time, in accordance to the terms of this Privacy Policy and the Terms of Use, but please note that the withdrawal of consent will not be retroactive.

b) Communications. By accepting this Privacy Policy you agree that we may contact you via email, notices posted on the WHAWHEE website, messages to your WHAWHEE inbox, or through other means available through the service, including text messages to mobile devices. You also agree that we may send a series of emails that help inform users about new features of the services and messages relating to the functioning of the services. We can also send messages with promotional information directly or on behalf of our partners, unless you have opted not to receive promotional information. Note that you cannot opt-out of receiving messages from WHAWHEE service. WHAWHEE will never send an EMAIL OR COMMUNICATION TO REQUEST YOUR PASSWORD OR ACCOUNT INFORMATION.

c) Information shared with third parties. As mentioned earlier, by default, the content posted via the Services is shared with the public, and this is an important feature of the Services. Such information includes anything you choose to upload or share. Because this type of information can be seen by anyone and can be indexed by search engines (such as Google Search), you must be careful with what you choose to disclose and make sure that it is information that you want to share with everyone. Furthermore WHAWHEE may share your information with third parties to provide services to you or third parties offering combined services with WHAWHEE. If we do this, the use of such third party information is subject to this Privacy Policy. As we develop our business, we may buy or sell assets or business offerings. The information about customers, emails, and the number of visitors is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution. Furthermore WHAWHEE may disclose your personal information if (i) We believe it is reasonably necessary to comply with a law, regulation or legal request; (ii) To protect the safety of any person, (iii) To address fraud and security or technical issues, or (iv) To protect the rights or property of WHAWHEE.

d) Searches. WHAWHEE offers search services to help find information and learn more about other members and activities. Search through WHAWHEE allows users to use more effectively WHAWHEE. We use information from user profiles to inform and refine our search service.

e) Advertising on WHAWHEE. To provide relevant and valuable publicity for you and your network, WHAWHEE can use your name and profile picture in connection with advertising based on the content shared by you on WHAWHEE. Such advertising may include the fact that you have recommended or endorsed a product or service on WHAWHEE, have joined groups or conversations, established or added content to your profile, among others. This ad will only be displayed on your profile.

f) Compliance with a legal requirement. WHAWHEE may need to disclose personal information, profile information and/or information about your activities as WHAWHEE user when required by court order or other legal process by a competent authority, or if WHAWHEE has a good faith belief that such disclosure is necessary to: (i) Investigate, prevent or take action regarding illegal activities or suspected to collaborate with governmental authorities, (ii) Enforce the Terms of Service, to investigate and defend ourselves against any third party claims or allegations or to protect the security or integrity of our site, and/or (iii) To exercise or protect the rights, property or personal safety of WHAWHEE, our users, employees, or others.

3. Options about handling your information. WHAWHEE offers the following options to manage your information:

a) Default Settings. In WHAWHEE we have established what we believe to be reasonable default settings that we consider that most users want. As mentioned earlier, by default, the Content posted via the Services is shared with the public, and this is an important feature of the Services. Such information includes anything you choose to publish or share. Because this type of information can be seen by anyone and can be indexed by search engines (such as Google Search), you must be careful in what you choose to disclose and make sure that the information that you want to share with everyone.

b) Accessing and changing your account information. You can review the personal information you provide us and make any desired changes to the information you post or share. Additionally, you can, decline to submit personal information through the Services, in which case we may not be able to provide you with certain services. You can update or correct your account information and email preferences at any time by logging into your account. If you are a registered user, you can access and remove most of the information associated with your account. Registered and unregistered users can access and delete cookies through their web browser settings.

c) Deleting your account. If you want to delete your account, you can do it from your profile page. If you decide to close your WHAWHEE account, we will remove your name and other personally identifiable information from our publicly viewable database. When you close your account, we have no obligation to keep your information and we may delete any or all of your account information without liability. However, the content you have posted or shared through our services might remain in cache, backups or regarding your information and it may not be removed immediately. Moreover, given the nature of sharing of WHAWHEE services, part of the account activity before the suppression may be stored on our servers, publicly accessible, for example, an email sent to another user and which resides in that persons Inbox of or publications or comments you may have made.

4. Additional provisions. In addition to the other provisions contained in this Privacy Policy, you should take into consideration the following aspects:

a) Privacy of children and minors. Persons wishing to use our site and/or any services provided by WHAWHEE on this site must be at least 14 years old; therefore, by accepting these Terms, you acknowledge you are at least 14 years old. WHAWHEE can contact you at any time, asking you to give us an actual proof of age picture ID document or equivalent. If such documentation is not delivered within the time you are told, WHAWHEE reserves the right to block or terminate your account. The identification data to be provided will be used exclusively by WHAWHEE’s authorized personnel for the task of identification, and in no case will be used for other purposes. If WHAWHEE is informed that a child under 14 is registered as a user on WHAWHEE, we will adopt the necessary measures and we can remove or block that user's account. If you are between 14 and 18 years of age it is recommended to always remain in the company of your parents or guardians when you’re using or interacting with WHAWHEE through our different interfaces, as well as when you are posting or sharing any content.

b) Changes to this Privacy Policy. We may update this Privacy Policy at any time with or without notice. In the event of significant changes we will post those changes on this page to keep you aware of what information we do collect, how we use it, and under what circumstances we may disclose it. Changes in this Privacy Policy will be effective once posted on this page.

5. Security. WHAWHEE uses commercially reasonable physical, technical and administrative safeguards to preserve the integrity and security of your personal information. To protect the data we store on our servers, WHAWHEE regularly audits its system for possible vulnerabilities and attacks. However, since the Internet is not a hundred percent safe environment, we cannot ensure or guarantee the security of any information you transmit to WHAWHEE or guarantee that your information on the services cannot be accessed, disclosed, altered or destroyed by breach of any of our physical, technical, or managerial security measures. In the event that personal information is compromised as a result of a security violation, upon learning of this WHAWHEE will promptly notify the persons whose personal information have been compromised, in accordance to the notification procedures set forth in this Privacy Policy, or as required by applicable law. Please note that emails, instant messaging, and similar media with other WHAWHEE users are not encrypted, and we recommend you not to communicate any confidential information through these means.
